Introduction

These Terms and Conditions govern the provision of photography and advert design services by Liljeros Design - Lina Hoggren ("the Photographer"). By booking a photoshoot or advert design service, the client ("the Client") agrees to be bound by these terms.



1. Prices and Fees


1.1 Packages:
  • Advert Packages: Pricing varies depending on the complexity and requirements of the advertisement. A bespoke quotation will be provided to the Client upon request.
  • Photo Packages: Various photo packages are available. Details of these packages and their respective prices can be provided upon request.


1.2 Photoshoot:
  • Photoshoot Session Fee: £50. This fee covers the Photographer's time for the photoshoot session itself.
  • There is no obligation for the Client to purchase photographs following the photoshoot.


1.3 Fees:
  • Non-refundable Booking Fee: A non-refundable booking fee of £25 is required to secure a photoshoot appointment. 
  • Photosession Fee: As outlined in section 1.2.
  • Field Rental Fees: For photoshoots conducted in private fields, the Client is responsible for any applicable field rental fees. By proceeding with a photoshoot in a private field, the Client agrees to adhere to the terms and conditions stipulated by the field owner. The cost of the field rental will be added to the total invoice.
  • Other Fees: Should the Client require expedited services or comprehensive editing, a fee may apply, depending on the complexity and time required. This will be agreed upon with the Client prior to the commencement of editing.
  • Travel Expenses: For locations outside of the Photographer's standard operating area, travel expenses may be incurred and will be discussed and agreed upon with the Client in advance.


2. Terms and Conditions


2.1 Use of Photographer's Photos:
  • Copyright: The entire copyright in all photographic images created during the photoshoot remains the property of the Photographer.
  • Personal Use: The Client is granted a license for personal, non-commercial use of the purchased photographs. This license permits the Client to display, share with family and friends, and reproduce the photographs for their own private purposes.
  • Alterations: The Client is permitted to modify or adapt the photos into new works for personal use, but the original photographs should not be altered (edited, cropped, etc.) in a way that misrepresents the Photographer's work.
  • Commercial Use, Sale, and Distribution: The Client is strictly prohibited from using the photographs for commercial purposes, or selling or distributing the photographs (either in digital or physical form).
  • Watermarks and Logos: Watermarks and logos applied by the Photographer must not be removed from any digital or printed photographs.
  • Immoral or Illegal Use: The Client must not use the photographs in any way that is immoral, illegal, offensive, or defamatory.
  • Misleading or Deceptive Use: The Client must not use the photographs in a misleading or deceptive manner.
  • Online Gallery: The Client's online gallery will be active for a period of fourteen (14) days from the date of notification. Following this period, the gallery will be closed. It is strictly prohibited to reproduce, screenshot, save, or use any photographs from the online gallery prior to purchase.
  • Waiver of Liability: The Client expressly releases the Photographer from all claims, damages, and liabilities that may result from accidents or incidents that occur during the photo session. 
  • Use of Images on the Web: When sharing photographs online (including social media), the Client is required to use only the small resolution digital image provided with the Photographer's logo. The logo must not be removed, and the images must not be edited (including colour changes or removal of any part of the image). High-resolution images (JPEG) without a logo are intended for print use only. The Client is prohibited from entering any purchased photographs into competitions (online or otherwise).
  • Prints: When purchasing prints, the Client is prohibited from scanning the print to create another print or a digital image. Digital images can be purchased separately.
  • Watermarking on Purchased Images: Watermarking (excluding the logo on web-sized images) will be removed from purchased digital images and prints after the order has been placed.


2.2 Pet Portrait Bookings:
  • Full payment of the booking fee is required at the time of booking a pet portrait session.
  • Appointments can be rescheduled up to ten (10) working days prior to the scheduled session date.
  • Booking fees for pet portrait sessions are non-transferable and non-refundable.
  • No Show: If the Client fails to attend their scheduled pet portrait appointment or does not provide at least ten (10) working days' notice of cancellation, the full booking fee will be forfeited.
  • The Client is entitled to a maximum of one (1) appointment change, provided that the request is made at least ten (10) working days before the original session date. Subsequent rescheduling requests will result in the loss of the booking fee.


2.3 ADVERT FEEDBACK, Image Selection and Viewing:
  • The Client will be presented with a selection of the best images from the photoshoot. Images that do not meet the Photographer's quality control standards will be discarded and will not be shown. The number of images provided for viewing is at the Photographer's sole discretion.
  • The Client's online gallery will be active for a period of fourteen (14) days from the date of notification. Following this period, the gallery will be closed. 
  • The Client must be available for review and feedback on the advert design starting one (1) week prior to the agreed deadline and remain available until the final approval.


2.4 Delivery of Photos and Adverts:
  • Photographs will be delivered to the Client via the website or invoice link after full payment has been received.
  • Advert designs in high resolution (in .jpg and .pdf formats) will be delivered to the Client after full payment of the invoice. Upon request, the final advert can be sent directly to the publisher.


2.5 Refunds for Digital Images:
  • Once digital images have been delivered to the Client, no refunds can be provided. It is the Client's responsibility to review the images upon receipt.


2.6 Client Responsibility for Digital File Storage:
  • Upon purchasing digital files, the Client is solely responsible for ensuring their safe storage and creating duplicate copies. Any requests for additional digital image duplicates from the Photographer will incur additional charges. Digital files are provided in JPEG format.


2.7 Photographer's Liability for Cancellation:
  • If Liljeros Design is compelled to cancel a photoshoot appointment due to circumstances beyond their reasonable control (including but not limited to death, injury, or illness), the Photographer's liability shall be strictly limited to a full refund of all monies paid by the Client.


2.8 Postponement Due To Adverse Weather:
  • If a photoshoot appointment must be cancelled by Liljeros Design due to adverse weather conditions, a new, mutually agreed-upon appointment will be scheduled at no additional charge to the Client.


2.9 LIMIT OF LIABILITY:
  • The Photographer exercises the utmost care in the exposure, retouching, and transportation of digital captures, proofs, and prints. However, in the unlikely event that all original images are lost, stolen, damaged, or destroyed due to circumstances within or beyond the Photographer's control, the Photographer's liability is limited to a full refund of all payments received from the Client, or, at the Photographer's discretion, a reshoot can be scheduled at no additional cost to the Client. 
  • In the unlikely event that the Photographer is injured or becomes too ill to attend the scheduled photoshoot, the Photographer will make every reasonable effort to reschedule the session to the earliest possible date. If rescheduling is not feasible, the Photographer's responsibility and liability are limited to the return of all payments received from the Client.


2.10 Animal Welfare and Client Responsibility During Photoshoots:
  • Throughout the photoshoot session, the owner or handler of the animal(s) is solely responsible for the behaviour and actions of their pets. Liljeros Design shall not be held responsible for any injury caused to the animal(s), the owner, or any third party during the photography session.
  • It is the Client's responsibility to inform the Photographer if they perceive any location or situation to be potentially dangerous for their pet or family member. If a pet needs to remain on a lead or has any medical or behavioural restrictions, the Client must inform the Photographer prior to and during the session. If the Client's animal exhibits aggressive behaviour, this must be disclosed to the Photographer to ensure the safety of all individuals present. The Photographer reserves the right to terminate the photoshoot session immediately if there are concerns regarding the animal's welfare, safety, or behaviour. In such instances, no refunds will be provided. The Client is responsible for maintaining control of their pet(s) at all times during the photoshoot.
  • The welfare of the animals participating in the photoshoot is of paramount importance. The session may be temporarily suspended or cancelled altogether if the animals exhibit signs of unease, discomfort, or any other adverse physical or emotional condition. Should Liljeros Design have any concerns regarding the welfare of the animal at any point during the session, Liljeros Design reserves the absolute right to terminate the session immediately.


2.11 Copyright License for Digital Images:
  • Clients purchasing digital images will receive a separate Copyright License Agreement from Liljeros Design. This license grants the Client the right to reproduce and distribute all purchased digital images for their personal enjoyment only. The Client is expressly prohibited from using the images for commercial purposes, entering them into photo contests, or altering the images in any way other than basic cropping for printing.


2.12 Online Sharing of Images:
  • Only images that have been specifically resized and watermarked for web use may be posted online. The Client will receive a watermarked web file of each purchased image for this purpose.


2.13 NOTICE OF COPYRIGHT:
  • Liljeros Design retains ownership of the copyright to all images created and shall have the exclusive right to make reproductions for various purposes, including but not limited to marketing materials, portfolio entries, sample products, editorial submission and use, advertising, or for display within or on the Photographer’s website and/or studio in all media forms now known or hereafter devised. Liljeros Design reserves the right to sell images for stock or commercial use.
  • The Client is solely responsible for ensuring they possess the necessary copyright permissions for any photographs they provide for inclusion in their advert design, unless the photograph was taken by the Photographer. The Client shall indemnify the Photographer against any claims arising from copyright infringement related to Client-provided images.


2.14 Model and Property Release:
  • This Agreement serves as a model and property release for the Client, their pets, and their child(ren) who are included in the photoshoot. By signing this contract, the Client warrants that they possess the full legal authority to agree to the use of the likeness of all persons and property included in the photographs in the manner described herein and shall indemnify and defend Liljeros Design against any legal claims arising from such use.


3. Data Storage Consent


By agreeing to these Terms and Conditions, the Client acknowledges and explicitly consents to the collection, storage, and processing of their personal data by Liljeros Design. This data may include, but is not limited to, names, contact information, email addresses, and information related to the photoshoot or advert design project. This data is collected and stored for the purposes of fulfilling the services requested, communicating with the Client, maintaining business records, and for potential future marketing communications from Liljeros Design (from which the Client can opt out at any time). Liljeros Design will take reasonable measures to ensure the security and confidentiality of the stored data in accordance with applicable data protection laws in the United Kingdom.
